Court rejects Malami’s application to vacate restraining order on Igboho
Justice Ladiran Akintola of Oyo State High Court 7 has rejected application by the Attorney General of the Federation (AGF) Abubakar Malami (SAN) for vacation of the order restraining him and security agencies from arresting or harassing Chief Sunday (aka Sunday Igboho) pending the determination of the suit.
The judge rejected the application at Monday’s sitting when raised by Malami’s lawyers.
The lawyers had argued that the court should vacate the order because it was an interim injunction which should not last longer than seven days. The order was given on August 4.
But the judge posited that vacating the order could renders the eventual judgment in the suit nugatory should Igboho be killed before it (judgment) is given.
He extended the order till next date of hearing.
Counsel to the Department of State Security (DSS) Mr T. A. Nurudeen later asked for adjournment to enable him file affidavit to the counter affidavit filed by Igboho’s Lead counsel Chief Yomi Alliyu (SAN) on the preliminary objection raised by Malami that the court lacks jurisdiction to entertain the suit
Alliyu initially objected to his position, stressing that rules of court only allow parties five days to file their reply being a fundamental human rights enforcement procedure suit. But the judge ruled that respondents could still ask for more time since Nurudeen proved that he had not been officially served the counter affidavit.
The court then adjourned to September 7 for a hearing.
In an interview with reporters, Alliyu said his team were currently more concerned about the plight of its clients being held by the DSS in Abuja against a court order.
He said: “We are mostly concerned with what is happening in Abuja. A court of law ordered that 12 people should be released and the DSS is sitting on that judgment.
“I have reminded them in my press release that the DSS leader should learn from Ibrahim Magu( former EFCC Acting Chairman).
“If you think you are in authority today, tomorrow, you may find yourself in the same trap which you set for your enemy. And I will implore everybody in this government, especially senior lawyers in this government, to advise this government against disrespecting the order of court.
“These people have not taken to arms. They have not done anything. We have shown that fundamental human rights involve self determination. They are merely asking for self determination.”
IPOB Members Arrested By Ghanaian Police
It was gathered that members of the proscribed group in Nigeria were arrested by the security operatives during a meeting and were transported in a van to a police station.
According to Genesis News, the IPOB members were arrested at Mallam Junction, Accra, Ghana.
This is coming after the presidency described members of IPOB as terrorists .
The presidency in a statement on Sunday signed by the senior special assistant to President Muhammadu Buhari on media and publicity, Garba Shehu said the group and its members are responsible for acts of terrorism in the southeast region of the country.
It blamed them for the attacks on police stations and other residents in the region, adding that the group is only hiding under the umbrella of struggling for freedom to perpetrate its acts of terrorism.
Governor Sule of Nasarawa Sacks Commissioners, Aides
Governor Abdullahi Sule of Nasarawa State, on Monday, sacked all his Commissioners, Senior Special Advisers and Special Assistants in the state.
Sule, who announced the dissolution of the state executive council’s shortly after an executive council meeting, thanked the commissioners and the aides for their sacrifices and contributions to the successes recorded by his administration.
The dissolution has finally laid to rest rumours of eminent cabinet dissolution that had been making the rounds.
Sources close to the government house told Vanguard exclusively that some of the sacked members of the cabinet would be reappointed.
Those most likely to be reappointed, Vanguard gathered, include the Information Commissioner, Dogo Shammah, the first serving journalist to be appointed as a commissioner since the creation of the state in 1996 by the Sani Abacha administration.
Others, according to the government house sources, include the Commissioner for Education and that of Local Government and Chieftaincy affairs.
Intense lobby among those waiting to be appointed has already begun since the return of the governor from the United States of America, where the decision was allegedly perfected.
It was not very clear when the new commissioners would be appointed, but it was however gathered that the appointments may be carried out before the local government elections slated for October 6.
